What Age Can Kids Legally Ride in the Front Seat in Texas?

In other words, a child cannot ride in the front seat of a standard passenger vehicle unless they can meet one of the following two legal requirements: 

  1. Eight Years of Age or Older: Children who are eight years of age or older are legally allowed to sit in the front seat—as long as they use the car’s seat belt. 
  2. 4 Foot Nine Inches or Taller: Children who have reached the height of 4 feet 9 inches may sit in the front seat with a regular seatbelt—even if they are not yet eight years of age. 

Note: TXDPS emphasizes that while it is lawful to let kids ride in the front seat if they meet either of the two conditions, it is often best to wait beyond the minimum mandatory requirement. Indeed, TXDPS notes that “if the child is not yet 4’9”, they are better protected if they continue to use the appropriate child safety seat system until they can properly fit in the adult safety belt.
